This means that we can process your application for a Grant of Legal Assistance for eligible Family Law matters.

To be approved for a grant of Legal Aid, you must typically satisfy three main criteria set by the relevant Legal Aid Commission:

Means Test
This test assesses your financial eligibility. It looks at your income and assets to determine if you can afford to pay for a private lawyer yourself. If your income and assets fall below the set thresholds, you may pass the means test.

Merit Test
This test assesses the legal viability and reasonableness of your case. It considers factors such as:

Whether the legal benefits you might gain justify the cost of providing legal aid.

Whether your case has reasonable prospects of success.

Whether a prudent person with limited money would risk their own funds to pursue the case.

Guidelines/Matter Test
This confirms that your legal problem is one that Legal Aid Commissions are funded to cover, and that it meets any specific criteria (e.g., complexity or urgency).
